What is SSDI?

Social Security Disability Insurance (SSDI) is a federal program that provides monthly benefits to people who are unable to work due to a medical condition expected to last at least one year or result in death. To qualify, you must have worked and paid Social Security taxes for a certain number of years.

SSDI (Social Security Disability Insurance) is based on your work history and the taxes you’ve paid into Social Security. SSI (Supplemental Security Income) is a needs-based program for people with limited income and resources, regardless of work history. Some people may qualify for both programs.
Initial decisions typically take 3-6 months. If you need to file an appeal, the process can take considerably longer—sometimes 1-2 years or more depending on your location and whether a hearing is required. We help ensure your application is complete from the start to minimize delays.
The SSA maintains a list of conditions that may qualify, but any medical condition that prevents you from working for at least 12 months may be eligible. This includes physical conditions, mental health disorders, and chronic illnesses. The key factor is demonstrating that your condition prevents you from performing substantial gainful activity.

The Application Process

What documents do I need to apply for SSDI?
You’ll need: your Social Security number, birth certificate or proof of age, names and contact information of doctors and medical facilities, medical records and test results, work history for the past 15 years, and most recent W-2 forms or tax returns. We’ll help you gather and organize all necessary documentation.
Don’t lose hope—many initial applications are denied. You have 60 days from the date of the denial letter to file an appeal. There are four levels of appeal: Reconsideration, Hearing by an Administrative Law Judge, Appeals Council Review, and Federal Court Review. We can help you through the reconsideration process and hearing preparation.
There are rules about working while receiving SSDI. The SSA has work incentive programs that allow you to test your ability to work without immediately losing benefits. This includes a Trial Work Period where you can earn any amount for up to 9 months. We can explain these rules in detail during your consultation.
SSDI benefits can be paid retroactively up to 12 months before your application date, but only after a 5-month waiting period from your established disability onset date. The timing of your application matters, which is why we encourage you to apply as soon as you become disabled.
